The plaintiffs point out that due to Delta Dental's large insured base in each state, participating dentists face a "take it or leave it" scenario: either accept low reimbursement rates or lose access to a substantial patient pool. Investigations show that despite rising premium rates in recent years, dentist reimbursement rates have long been below or merely equal to market rates. This imbalance reflects the tilted bargaining power resulting from high market concentration in the insurance sector.
Currently, the plaintiffs in all four lawsuits seek injunctive relief to halt anti-competitive practices, along with treble damages and specific remedial measures to restore competition.
